Merchant terms

Last updated: 4 November 2026.

Text to be reviewed by a lawyer. These terms describe Weby 2.0; they will be reviewed before they are final.

This page is a translation of the French terms; if the two differ, the French version prevails.

These terms apply to you if your store uses Weby. The terms of use also apply, for everything about your account.

1. What Weby provides

Weby, published by Simon Gracies EI (see the legal notice, in French), is self-checkout point-of-sale software: your catalogue, the app where your customers scan their items and pay, the receipts and their journal, the check of receipts at the exit, and the space where your team manages all of this.

You are the seller. The sale binds your customer and your store. Weby is not a party to the sale: you remain responsible for your products, your prices, the VAT you apply, the guarantees owed to the customer, returns, the sale of alcohol, your professional obligations and your insurance.

2. The subscription

Weby is a subscription per store, that is, per address. It is taken out with Weby, as a business, outside the app: the app shows no price and no purchase link. The price, term, billing and termination of the subscription are those of the offer you accept with Weby.

Weby takes no commission on your sales: the subscription is the only amount you owe it.

3. Payment: your Stripe account

Your customers pay on your store's Stripe account, an Express account that the owner opens from the store's space. Onboarding is done at Stripe, which itself verifies the identity of the business and of its representative, and the bank account that receives the payments. By opening this account, you accept Stripe's terms, which bind you directly to Stripe.

Payment in the app only opens in your store once your Stripe account can accept payments, and once Weby has put in place everything section 4 requires of point-of-sale software. Until then, your customers pay at the checkout.

4. Weby, point-of-sale software

A merchant liable for VAT who records sales in software must be able to prove that the data is unalterable, secured, retained and archived (article 286, I, 3° bis of the French General Tax Code). Weby is the publisher of this software.

What is in place:

What remains to be done before your first real sale: closings (daily, monthly and yearly) with the perpetual grand total, dated and signed archives, and credit notes (a correction or a refund is recorded as a new line referring to the original receipt). Weby then gives you its individual publisher's certificate, which you show to the tax authorities if they ask for it.

The certificate covers Weby used as these terms provide. A sale you record elsewhere falls under your other point-of-sale software.

5. Retention of your sales journal

Weby retains your store's sales journal for at least 6 years (article L102 B of the French Book of Tax Procedures), including after you leave Weby or your subscription ends. On your written request to contact@tryweby.com, Weby gives you a copy readable by the tax authorities, within 30 days.

Your other retention obligations (for example, 10 years for accounting records, article L123-22 of the French Commercial Code) remain yours: request your copy in time.

6. Your catalogue and your prices

Your catalogue (barcodes, labels, prices including taxes, VAT rates, alcohol flag) is your responsibility. You import it from a file or edit it item by item; the date of its last update is visible.

7. The exit check

Your team can scan the QR code of a customer's receipt at the exit. The app answers at once: valid receipt, already checked (with the time), receipt from another day, or unknown in this store; it shows the items, and whether the receipt contains alcohol. Each check is recorded with its time and result, without the name of the person who checked.

The check, and what you do with it, are up to you, under your rules and the law. When a receipt contains alcohol, you check the customer's age: selling alcohol to minors is forbidden. Weby gives the information, and makes no decision in your place.

8. Your store and your team

To publish your store, you declare its name, address, location, SIRET number and VAT number (of the same SIREN), and you have at least one active item. You warrant that you are authorised to represent the store. Weby only opens stores located in France for now.

The name, address and location of a published store are public: that is how it can be found. The SIRET and VAT numbers are printed on every receipt, as the law requires.

Your team has an owner and members: manager, cashier or security. The owner and the manager edit the store and the catalogue; all of them read the store and check receipts. Only the owner manages the Stripe account, adds or removes a manager, and removes the store from Weby. You join a team with an invitation code, valid for 24 hours and once only. Anyone can leave the team on their own.

9. Unpublishing, leaving Weby

You can unpublish your store at any time: it disappears from the customers' app, and you can publish it again.

The owner can remove the store from Weby. This is final: no further action is possible on the store, but its sales journal is retained (section 5). Coming back is a request to support. The end of the subscription follows the offer you accepted.

The owner of a store still on Weby cannot delete their account: they remove the store first.

10. Personal data: who is responsible for what

Your store's sales journal belongs to you. For this journal, you are the controller, and Weby keeps it on your behalf, as processor (article 28 of the General Data Protection Regulation).

A customer's account is Weby's responsibility, as controller: sign-up, sign-in, saved cards, cart, and the link that lets the customer find their receipts in the app. The same goes for the account of each member of your team. See the privacy policy. When a customer deletes their account, their receipts stay in your journal, with no link to them.

For what Weby does on your behalf:

If your business was on Weby before version 2.0, the data your team entered then (walk-in customers, staff, absences, invitations) remains processed on your behalf under the terms of 21 October 2026, until it is cleaned up, which will be announced to you.

11. What Weby may do

12. What Weby does not guarantee

The service is provided as is. Weby does not guarantee uninterrupted availability: if the app does not work, your customers go through the checkout. Nor does Weby guarantee the precision of phones' locations: a customer always confirms the store they are in.

13. If your business was on Weby before version 2.0

Until version 2.0, Weby was a marketplace for restaurants and bars (bookings, orders, paying the bill). These features are no longer in the app. What was done with them remains governed by the marketplace terms of 21 October 2026, a copy of which you can request at contact@tryweby.com.

14. Term, changes, governing law

These terms apply as long as your store uses Weby, then for what must survive them (sections 5 and 10). They may change: the date at the top of the page says when, and a change that concerns you is announced at least 30 days before it applies. They are governed by French law.
