Weby Français

Terms of use

Last updated: 4 November 2026.

Text to be reviewed by a lawyer. These terms describe Weby 2.0; they will be reviewed before they are final.

This page is a translation of the French terms; if the two differ, the French version prevails.

1. What Weby is

In a partner store, Weby lets you scan your items yourself with your phone, pay in the app and leave with your receipt, without going through the checkout.

Weby is published by Simon Gracies EI (see the legal notice, in French). Weby provides the app, and the point-of-sale software the store uses.

The store is the seller. When you buy, the sales contract binds you to the store, not to Weby. The store sets its prices, answers for its products, and owes you the seller's legal guarantees (legal guarantee of conformity, guarantee against hidden defects). Weby sells nothing, sets no price and takes nothing on your purchases.

2. Your account

Weby is for people aged 18 or over. By creating an account, you declare that you are at least 18. An account opened by a minor is deleted as soon as Weby learns of it.

Without an account, you can open the app and see the map and the list of stores. You need an account to scan an item and to pay. You agree to give a valid email address and accurate information. An account is personal: you are responsible for what is done from yours.

The role chosen at sign-up, customer or business, does not change afterwards. If you chose the wrong one, support opens the right account.

You can delete your account at any time from the Account screen of the app: how to do it, and what goes or stays. Your receipts stay in the stores' sales journals, which the law forbids altering, but nothing links them to you any more.

An account with no sign-in for 2 years is deleted, in the same way, after a warning email sent 30 days before: signing in is enough to keep it. This does not apply to the account of the owner of a store still on Weby, nor to an account with a payment in progress.

3. Choosing the store

If you allow it, the app reads your location, only while it is open, to propose the Weby store you are in. It always asks you to confirm: "Are you at …?". You can also choose the store on the map or in the list.

A phone's location is imprecise inside a building, and two stores can be next to each other. Check the name of the store shown before you scan: you pay the store you chose.

4. Scanning and your cart

Each scanned item is added to your cart at the price in the store's catalogue. You change quantities or remove an item whenever you like. If an item is not found, ask the staff.

The store undertakes that the price in the app is the shelf price. If you see a difference, tell the store staff: the store sets its prices, and it is up to the store to settle the difference.

Before paying, you validate your cart: prices are read again, an item withdrawn from the catalogue in the meantime is removed, and a total that has changed is shown to you. The validated total is frozen for 15 minutes; after that, you validate again. A cart with no activity for 4 hours is abandoned.

5. Paying

You pay in the app when the store has opened payment in it: the "Pay" button only appears in that case. Otherwise, you go through the checkout as usual.

You pay with a card you have saved, or with your phone's wallet (Apple Pay on iPhone) when it is offered. The amount is the validated total, in the store's currency, taxes included.

The payment goes directly to the store, on its own account with Stripe, the payment provider. Weby does not receive your money and takes no commission: you pay nothing more than the store's price.

Card numbers never pass through Weby: you enter them with Stripe. Your saved cards are kept by Stripe for Weby; when you pay, the chosen card is copied at Stripe to the store's account. You can remove a saved card at any time.

A cart is never paid twice. If your bank declines the payment, your cart can still be paid another way.

6. Your receipt and the exit

As soon as the payment is accepted, your digital receipt appears, with the store and its legal details, the items, the totals, the VAT and the payment method. You find it afterwards among your receipts. It is part of the store's sales journal, which is never altered or erased.

The receipt carries an exit QR code. At the exit, the store staff may scan it: they see whether the receipt is paid, the number of items, whether it contains alcohol and whether it has already been checked. Show it when asked. Your QR code is personal: do not share it.

The exit check is carried out by the store, under its rules and the law. Weby gives it the information, and makes no decision in its place.

7. Alcohol

Selling alcohol to minors is forbidden. When your cart contains alcohol, the receipt says so, and the store staff check your age at the exit: they may ask for an ID. If you cannot prove your age, the store may refuse to let you take the alcohol; the refund of those items is settled with the store. Weby keeps nothing of this check.

8. Returns, refunds, complaints

A return, an exchange, a refund or a complaint about a product is settled with the store, under its rules and the law: it is the seller. If you cannot reach it, support can help.

For a problem with the app itself (a payment you do not recognise, a receipt that does not appear), write to support.

9. Weby Démo

Weby Démo is a demonstration store, visible to everyone, last on the map and labelled "Démonstration". It is there to discover the app. It is not a real store: nothing is sold there, and its payment is refused, except for Weby's test accounts, for which it charges nothing. A Weby Démo receipt is labelled "Démonstration" and has no value.

10. What Weby may do

11. What Weby does not guarantee

The service is provided as is. Weby guarantees neither uninterrupted availability, nor the accuracy of catalogues and prices, for which the stores are responsible, nor the precision of your phone's location. If the app does not work, you go through the checkout. Weby fixes what is reported to it.

12. Personal data

See the privacy policy, which describes what is collected, who reads it and what survives an account deletion.

13. If you used Weby before version 2.0

Until version 2.0, Weby was used to book and order in restaurants and bars. These features are no longer in the app. What you did with them (bookings, orders, payments, reviews) remains governed by the terms of use of 21 October 2026, a copy of which you can request at contact@tryweby.com.

14. Changes to these terms

These terms may change. The date at the top of the page says when. A significant change will be announced in the app.

15. Governing law

These terms are governed by French law. If you are a consumer, you keep the benefit of the mandatory provisions of the law of your country of residence, and you may bring a claim before the court of your place of residence.
